Does H1B Visa Cap / Quota Apply to Residencies ?

You might have heard that starting 2005, the H1b Visa 'cap' - or the upper limit to the yearly allowed H1B visa sponsorship grants - has been raised to 65,000 per year and an additional 20,000 H1B visas are reserved for people who have completed a Master's or a PhD from an American graduate school.

However IMGs aiming for H1B Residencies can breath easy at least on that front.

1. These 'caps' are only meant for 'For-profit' organizations like Microsoft, GE, Oracle, Google, etc. - they DO NOT apply to most medical residencies, since they are usually a part of 'not-for-profit' hospitals and Universities labeled as academic institutions with the purpose of serving the community. In short, the H1b visa can does not apply for doctors working in non-profit sectors , including residencies and fellowships. But, if a foreign doctor were to be hired by a for-profit company, the H1b visa caps do apply.

2. Now what if you were transferring from a previous for-profit H1b to a not-for-profit residency H1B Visa ? Again good news - The H1B Transfer is a separate process and has nothing to do with the H1B Cap / Quota. The H1B visa cap applies ONLY TO the first timers. I have heard that an H1b visa transfer from a non-profit organization to a medical residency may be much easier than a transfer from a for-profit H1b to a non-profit residency for IMGs

3. Do note that there are a few residencies who do fall under the annual cap system. For example the St. Vincent's Internal Medicine program.

4. Also, do note that while the US govt. does not impose quotas on non-profit H1b visas, the residency programs often do have internal quotas on the number of H1b visas to give out, often depending on state laws that which were made to address issues of physician excess in the United States.


So IMGs....the next time you hear the the H1B quotas were already used up on the first day itself, don't break into a sweat !

You have mentioned that St. Vincent's Internal Medicine program falls under annual H1B cap system. Could you provide list of such medical schools which fall under Annual H1B cap?

There will be not be too many of such programs - and will be a herculean task to sieve them out - but something I can keep in mind when time permits in the future :-) Thanks for the gr8 suggestion

i have a question regarding the programs in which the residents have to rotate in moire than oine hospital.. is it possible to sponsor an H1b visa then , Given that it is a non profit organization?

Even if you rotated in different hospitals in a residency programs, your employer and stipend-giver is the same single residency program. A single residency program could resident contracts with different hospitals in the area, or it could be that all the hospitals are a part of a single integrated delivery network (IDN). So a H1b is certainly possible for the residency period, since it's a single employer eventually - its all upto the program or the organization policies

Hey digital doc, i am working in a phrama companay on H1 B as a clinical research assitant and will apply for residency in this septermber 1st for 2009 match. But as i will already utilise my first year of H1 B in pharma company , then i wil left with 2 years for H 1 B ( it is for profit organisation ) will i find any difficulty when i will apply for residnecy which are not for profit organisation ? as i will have 2 years left for H 1 B then . please guide me as soon as possible, thanks for your advice

Hi you will residency programs willing to transfer H1b to their programs. H1b goes on for a total of 6 years even if you change employers within that period.

HI Digital Doc,
I am on a B1 visa and got an interview offer frm St vincent Hospital, worcester.I heard that they are not exempt frm H1 b visa cap.I wanted to know will they now sponsor any H1 visa or not?
I have prematched at one more hospital in newyork which is sponsoring H1 visa.I am wondering wether should i take this offer or not..I havent interviewed at st vincet hospital.Wat shuld i do now..Shuld i wait until the interview at st vincent or take this prematch offer with H1 visa.??
