DIFFERENT TYPES OF J1 VISAS


It is not just for Residencies that the J1 Visa is granted.



Besides the clinical Residency or Clinical fellowship J1-visa sponsored by the ECFMG, here are the other categories of J1 visas :


- Research Scholar (3 years maximum)
- Professor (3 years maximum),
- Specialist (1 year maximum),
- Short-term Scholar (6 months maximum),
- Student (necessary time to complete degree, must be enrolled full-time in a degree program)

Note that an IMG holding a clinical J1 is called an "Alien Physician" - yeah, almost sounds as if you came from Mars ;-)

Now, in the context of IMGs, this is important to know since NOT ALL J1-Visas have the 2-year Home Residency Requirement ! So, some of you come for a PhD on a J1 OR come for an Elective / Observership / Externship on Visiting Student Program - but don't need really need to go back to your own country for two years before converting to a work visa.


Here are the things that WILL MAKE J1 VISA obligated for the 2-year Home Residency Requirement:


- If you sponsored by ECFMG - like GME residency / fellowship and ECFMG Sponsored Research scholars
- If you are funded by your Home country government for the exchange student program
- If you receive direct funding from the U.S. government
- If you have skills that are on U.S. government's needed skills list, or
- If you are a J-2 dependent of a J-1 who is subject to any of the above!


The rest of the J1 types can continue to stay in the US and get themselves H1b visa Sponsoring jobs.

Note:

Do not confuse the 2-year bar from the 2-year Home-Country Residence requirement. The 2-year Bar that some research J1s have imply that the person must spend 2 years on other status (which can include H1b) before getting back to a Research Scientist J1 position again . While the 2-Year Home-country Requirement Rule states that the person must spend two years back home or get a waiver, before changing to a work-visa

I am on 1 year J1 visa with 212 (e) section.2 yr home country requirements on my visa. i am doing my observer ship at Rothmans institute’s. i am not paid by any one.(us/Indian govt.).Still i have that stupid home country stay requirement. i need to take up my residency (usmle) what should i do ? i need to change to H1 is that possible?

What is the duration of your J1 visa ? If its seven years, you will have to take a residency on that J1 visa itself, or else complete the 2-year requirement and get back to try for an H1 residency. Since you have not completed a residency yet, you cannot avail for J1-waiver physician jobs. I am curious to know - who is the sponsor of your J1 Visa ?

duration of my J1 visa is for 1 year upto jan 2008. sponsor of my J 1 visa is professor from the rothman instituteunder whom i am doing observership and some research work.i have planed for usmle and get residancy in 2008/9.is that possible.will have to extend my visa for 2 years.confussed what should i do.?

Hello digidoc,

I am still confused about J1 research visa. I read your blog on J1 research to j1 clinical visa..
Can you please tell who is the official person, I can ask everything in detail and clarify everything?
if I take J1 research visa this year say in april-may and if it is for 1 year, and if I match next year in march 2009 , is that still possible to convert J1 research to J1 clinical/ H1 clinical, considering that if I do not have 1 year HRR... And what if i have 2 year HRR in the same above case...

Hi digidoc i have the same question as that of the preceeding post that if i take up 2 yr j1 research visa in may 2008 can i convert it to clinical j1/h1 if i match for 2009 or do i have to complete those 2 yrs before becoming eligible for that.
Please reply soon as i need to make a decision soon on the matter.
