More About Residency and J2 Visas

Q. Can I Do a Residency on a J2 Visa - or Do I have to get my Own J1 Visa ?

A. Yes - You can start Residency on a J2 Visa ..coz you are allowed to work on a J2 Visa after obtaining a work permit. (You don't need a job in hand while applying for the permit!)


Q. How long is the Work Permit or EAD (Employment Authorization Document) Valid ?

A. For one Year - and then needs to be renewed. It is generally recommended that you apply for the re-validation about 3.5 months before the expiry date each time.


Q. How long does it take for a J2 to arrive or get processed after I marry to a J1 guy / gal ?

A. Takes about 30 days to get the J2 Processed after marriage


Q. Can I change my status from J2 to H1b directly ?

A. If the J1 of the primary visa holder is subject to a two-year Home Residency Requirement (HRR) - read type of J1 visa, then NO - a J2 Visa holder cannot change to H1b directly. The J2 can only do so IF the J1 holder gets a waiver OR if the J2 holder completes the 2-year HRR .

However, If the primary J1 visa is not subject to a 2-year HRR, then you may directly get a H1b job, residency or fellowship.

could u pls tell me this

1) if someone has j2visa, while applying to residency , can we apply to places who donot sponsor visa??
2)also do programs favor somebody who do not need visa... i mean if u have j2 while apllying is it better than having b1/b2 and needing sponsorship

Yes you could apply to places that do not sponsor visas, but still find out after calling if they allow J2 visas, since I know a program which banned J2 after a person had to leave after the J1 was removed from residency elsewhere and J2 had to go too -

On the expected visa section - mention both J-2 and Employment Authorization.

Yes, Programs do favour non-visa needing IMGs, but some programs, as I said may have policies on accepting J2s or maynot know that J2 dont need to be 'sponsored' by them - hence you shud still call programs before applying to find out

Hi Digidoc,
This is an awesome website.
I have a question.
I am on J-1 with 2yr HRR , finishing my program Feb 2009.
My wife just got residency and she has got EAD. Question is what happens if I get a J-1 waiver? I think she won't be able to get EAD 'cos my waiver would be like a H1B and she won't get a EAD on H-4.(Correct me if I am wrong)

Program won't sponsor H1B.
She would need to get J-1 ? or can she continue to get EAD while I am on J-1 waiver?
Thanks for your help.

hello, you are right. The J2 holder's EAD is valid until the J-1 visa holder’s DS 2019 end-date or one year, whichever is shorter.

Hence, once you are out of J1 status on your waiver job, the J2 EAD will not be valid.

If the program does not sponsor an H1b for the spouse, then a independent J1 for the previously J2 holder will be needed for the residency, if possible, an O1 visa could be used too.
